Terms of Service

These Terms of Service ("Terms") are an agreement between you and Genius at Large, Inc. ("HERO2", "we", "our", or "us"). They cover the HERO2 mobile application (the "App") and hero2.org (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who Can Use HERO2

• You must be at least 13 years old to use the Service. If you are under 18, you may use it only with the permission of a parent or guardian.
• Most of the App needs an account. Give us accurate information, keep your password private, and tell us at team@hero2.org if you think someone else has used your account. You are responsible for activity on your account.
• One account per person.
• Some features are offered in early access, to people on our waitlist, or to certain campuses, chapters, or cities. They may change or not work as expected.

2. Trips and Estimates

With your permission, the App uses your phone's location and motion data, including in the background, to detect trips and work out how you traveled. Our Privacy Policy explains what we collect and how we use it.

Detected trips, travel modes, distances, and CO2 figures are estimates made automatically. They can be wrong, late, or missing, and we may correct them, together with any Power they earned. CO2 figures are estimates for your information only. They are not verified emissions reductions, offsets, or carbon credits.

3. Power

• You earn Power for trips the App detects and confirms. The App shows how Power is earned and what rewards cost. We may change these amounts and rules from time to time.
• Power has no cash value. It is not money, a gift card, or a cryptocurrency. You cannot buy, sell, or transfer it, exchange it for cash, or move it to another account.
• We may correct Power given by mistake and remove Power earned by breaking these Terms.
• Power ends when your account is closed or deleted, or if we stop offering Power.

4. Rewards From Local Businesses

• Rewards are offered by independent local businesses ("Businesses"). Each Business decides its rewards and is responsible for providing them. HERO2 does not make or sell the goods or services, and is not responsible for them or for disputes between you and a Business.
• Rewards depend on availability and on any conditions shown in the App, such as a Business's opening hours or the times a reward can be used. A Business or HERO2 may change, pause, or end a reward at any time.
• When you claim a reward, its Power cost comes out of your balance right away. Redeem it at the Business by showing the App to staff before the time the App shows. If a claimed reward expires before you redeem it, the Power used to claim it may not be returned.
• Each claimed reward can be redeemed once. Rewards have no cash value and cannot be resold or exchanged. If something goes wrong with a reward, contact the Business or email us at team@hero2.org.

5. Leaderboards, Chapters, and Friends

If you use leaderboards, chapters, or friend features, other members may see your username, character, rank, and Power. We do not show other members your trip routes or location history. Choose a username that is not offensive or misleading and is not someone else's name. We may change or remove a username that breaks this rule.

6. Play Fair

You agree not to:

• Fake or inflate trips, for example by spoofing your location, using emulators or automation, or having someone else carry your phone
• Create or use more than one account, or use someone else's account
• Use bots, scripts, or other automated means to access the Service
• Exploit bugs or errors to get Power or rewards (please report them to us instead)
• Harass, threaten, or impersonate anyone
• Break the law, or help anyone else break it, through the Service
• Try to break into, disrupt, overload, or reverse engineer the Service, except where the law allows it

If we believe you have broken these rules, we may remove Power, cancel claimed rewards, remove you from leaderboards, or suspend or close your account.

7. Stay Safe

Follow traffic laws and pay attention to your surroundings. Do not use the App while driving, cycling, or crossing the street. You are responsible for your own safety and for choosing how, when, and where you travel.

8. Our Content and Yours

The Service, including the HERO2 name, wordmark, characters, designs, and software, belongs to HERO2 or our licensors. We give you a personal, limited, non-exclusive, non-transferable, and revocable license to use the App on Apple devices you own or control, for your own non-commercial use, under these Terms.

You keep any rights you have in content you add, such as your username. You allow us to store and show that content as needed to run the Service. If you send us feedback or ideas, we may use them without owing you anything.

9. Apple App Store

If you downloaded the App from Apple's App Store, Apple's Licensed Application End User License Agreement also applies. These Terms are between you and HERO2, not Apple. Apple is not responsible for the App or its content, has no duty to provide maintenance or support for it, and is not responsible for handling claims about it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Changes and Ending

• We may change, pause, or stop any part of the Service, including Power, rewards, and leaderboards.
• We may update these Terms. When we do, we will change the effective date at the top of this page and, where appropriate, tell you in the App. If you keep using the Service after a change takes effect, you accept the updated Terms.
• You can stop using the Service at any time and delete your account in the App's Profile screen. We may suspend or close your account if you break these Terms or if we need to for legal or security reasons.
• When your account ends, your Power and any unredeemed rewards end with it. Parts of these Terms that by their nature should continue, such as Sections 3, 11, 12, and 13, keep applying.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, HERO2 makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Service will always be available or free of errors, that trips, Power, or estimates will be accurate, or that any reward will be available.

12. Limitation of Liability

To the fullest extent the law allows, HERO2 and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Service or these Terms. Our total liability for any claim related to the Service is limited to the greater of US$100 or the amount you paid us for the Service in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules.

14. General

These Terms and our Privacy Policy are the whole agreement between you and HERO2 about the Service. If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these Terms, that is not a waiver. You may not transfer these Terms to anyone else. We may transfer them as part of a merger, acquisition, or sale of assets.
